The Luxury Ones — Seller Terms and Conditions
The Luxury Ones operates on a consignment-based sales model, which means payment is made to the seller only after the item has been successfully sold.
The following Seller Terms and Conditions govern the sale of goods facilitated through the services provided by The Luxury One (hereinafter referred to as “The Luxury Ones,” “TLO,” “we,” White Label, “us,” or “our”).
These Seller Terms and Conditions are incorporated into and form an integral part of the company’s Terms of Use. By consigning an item for sale through The Luxury One, the seller agrees to be bound by these Seller Terms and Conditions, as well as the applicable Terms of Use.
By using the services provided by The Luxury One ("TLO"), sellers acknowledge that they have read, understood, and agreed to be bound by these Seller Terms and Conditions. By accessing or using TLO's services, sellers represent and warrant that they are legally competent and have the authority to enter into and comply with these terms. Sellers who do not agree to or comply with these terms are not authorised to list, sell, or transact any products through TLO's platform.
For the purposes of these Seller Terms and Conditions, the terms "you" and "your" refer to the seller. If you use TLO's services on behalf of an organisation, company, or any other legal entity, then: (i) "you" shall include both the individual seller and such entity; (ii) you represent and warrant that you are duly authorised to act on behalf of and bind the entity to these Seller Terms and Conditions.
All sellers using TLO's services are required to accept and comply with these Seller Terms and Conditions in their entirety. For any questions or clarifications regarding these terms, please contact The Luxury One at team@theluxuryone.com.
1. CONSIGNMENT ITEMS
Price Quotes
Sellers may submit photographs and descriptions of their products to The Luxury One ("TLO") for evaluation and potential sale through its platform. Upon receiving the submission, TLO will review the information provided and determine, at its sole discretion, whether the item is suitable for consignment.
If the item is accepted, TLO will provide the seller with a proposed consignment price quote via email or any other approved communication channel. If the item is not accepted, TLO will notify the seller accordingly. Upon the seller's acceptance of the consignment offer, TLO will arrange for the collection of the item or the seller has to ship it to The Luxury One’s office.
Consignment Period
The standard consignment period shall be one hundred (100) days from the date the item is listed on TLO's platform. Upon expiry of the initial consignment period, the seller may elect to extend the listing for an additional period of thirty (30) days. To facilitate a quicker sale, TLO may recommend revising or reducing the listing price during the extension period.
Assessment and Authentication
Upon receipt of the Consignment Item, TLO will inspect and assess the item to verify its first level of authentication and confirm that its condition matches the description, photographs, and details provided by the seller in the original submission.
a. Authentic Items in Represented Condition
If TLO determines that the Consignment Item is authentic and substantially matches the condition represented by the seller, TLO will list the item for sale on its website and may promote the item across its marketing channels, including social media platforms and other promotional mediums.
b. Authentic Items in a Different Condition
If TLO determines that the Consignment Item is authentic but its condition differs materially from the seller's original description, or if expected accessories such as locks, keys, straps, dust bags, authenticity cards, or pouches are missing, TLO may issue a revised consignment offer reflecting the updated assessment.
If the seller accepts the revised offer, TLO will list and promote the item at the updated price. If the seller declines the revised offer, the item will be returned to the seller, and all shipping, handling, and related costs shall be borne by the seller.
c. Unauthenticated or Counterfeit Items
If TLO determines, at its sole discretion, that the Consignment Item is not authentic, suspected to be counterfeit, or cannot be authenticated with reasonable certainty, TLO reserves the right to reject the item and initiate the cancellation procedures set forth in Section II.2(b) of these Seller Terms and Conditions. Counterfeit fees is charged for each item.
2. AUTHENTICITY & CANCELLATION
Authenticity
The seller represents and warrants that all items submitted for consignment sale ("Consignment Items") are genuine, authentic, and legally owned by the seller. All determinations regarding authenticity shall be made solely at The Luxury One's ("TLO") discretion. No item shall be considered authenticated until it has been physically received, inspected, and approved by TLO.
If a Consignment Item is determined to be counterfeit, inauthentic, or cannot be authenticated with reasonable certainty, TLO reserves the right to reject the item. The seller shall be required to pay an authentication and handling fee of INR 5,000 per item, following which the item will be returned to the seller at the seller's sole expense.
Cancellation
If, at any time, TLO determines that a Consignment Item is counterfeit, inauthentic, or otherwise ineligible for sale under these Seller Terms and Conditions, TLO reserves the right to immediately remove or refuse the item from its platform and charge the seller.
Where payment has already been made to the seller for such item, the seller shall:
- i. Immediately refund to TLO any amounts paid in relation to the Consignment Item;
- ii. Pay a counterfeit penalty fee of INR 5,000 per item. TLO further reserves the right to initiate legal proceedings against the seller in cases involving counterfeit, stolen, or misrepresented goods; and
- iii. Bear all shipping, handling, and associated costs for the return of the Consignment Item.
If any authentication fee remains unpaid for a period exceeding thirty (30) days from the date of notification, TLO reserves the right, to the extent permitted by applicable law, to dispose of, destroy, or otherwise deal with the item at its sole discretion, without any further liability to the seller, it will be disposed.
3. PRICING, FEES & DISCOUNTS
Pricing
TLO reserves the exclusive right to determine the listing price of all Sale Items based on factors including, but not limited to, brand, condition, age, rarity, market demand, completeness of accessories, and prevailing resale values of comparable products.
Any pricing communicated to the seller is indicative and does not constitute a guarantee of sale, valuation, or future payment. TLO may, at its sole discretion and at any time, revise the pricing, availability, descriptions, specifications, or features of any product listed through its platform.
TLO further reserves the right to adjust prices, introduce discounts, promotional offers, markdowns, or correct pricing errors that may inadvertently occur. Any such revisions shall become effective immediately upon updating the listing or notifying the relevant parties.
4. TERM & TERMINATION
Term
These Seller Terms and Conditions shall become effective upon TLO's receipt of a Consignment Item.
The initial consignment period for each item shall be one hundred (100) days from the date of receipt by TLO ("Initial Consignment Term"). Upon expiry of the Initial Consignment Term, the listing may be extended upon mutual agreement between the seller and TLO.
If the seller wishes to retrieve their Consignment Item after the expiry of the Initial Consignment Term, the seller shall be responsible for arranging and bearing all costs associated with the collection, shipping, handling, and insurance of the item from TLO's office or designated location.
Early Termination
During the Initial Consignment Term, if the seller requests the return or withdrawal of a Consignment Item before the completion of the 100-day period, TLO shall be entitled to charge an early withdrawal fee of INR 2,000 per item.
The seller shall also bear all applicable shipping, handling, insurance, and related expenses associated with the return of the item.
5. PROMOTION
Upon successful authentication of the product and execution of the consignment agreement by the seller, The Luxury One ("TLO") will commence the onboarding process for the item. Subject to completion of all necessary inspections and documentation, TLO will endeavour to photograph, catalogue, and publish the product on its website and initiate promotional activities within approximately eight (8) to ten (10) business days.
TLO may promote the product through channels it deems appropriate, including but not limited to its website, social media platforms, email marketing, paid advertisements, content creation, and other online or offline marketing initiatives. The nature, extent, and duration of such promotional activities shall be determined solely at TLO's discretion.
6. PAYMENTS
Payments
Subject to these Seller Terms and Conditions, The Luxury One ("TLO") shall release payment to the seller only after:
- i. The Consignment Item has been successfully sold;
- ii. The purchaser's payment has been received and cleared in full;
- iii. The item has been delivered to the purchaser; and
- iv. No exchange, dispute, chargeback, or cancellation request has been initiated by the purchaser within the applicable return period.
Payments may be made through direct bank transfer or issued as The Luxury One Store Credit, as mutually agreed between the seller and TLO.
For completed sales, TLO will process the seller's payout within 2 business days after the sale has been successfully concluded and all applicable conditions have been satisfied.
SELLER SUMMARY & IMPORTANT CONDITIONS
For further emphasis and clarity, the seller acknowledges and agrees to the following:
- The seller is the sole, lawful, and rightful owner of the product(s) submitted for sale and has full authority to consign and sell such product(s).
- The seller possesses the legal capacity and authority to make all decisions concerning the sale of the product(s).
- All product(s) submitted to TLO must be authentic luxury products acquired through lawful means.
- Under no circumstances shall replica, counterfeit, imitation, first-copy, fake, altered, or stolen items be submitted for sale.
- The seller must ensure that all bags, accessories, and products submitted to TLO are completely emptied of personal belongings and valuables prior to shipment.
- If personal belongings are found within a submitted item, TLO may notify the seller as a courtesy. However, TLO takes no responsibility or liability for any personal belongings, valuables, documents, cash, or other items found in or missing from the product.
- Upon receipt, all products will undergo a detailed inspection and authentication review. If a product does not meet TLO's quality standards or eligibility criteria, the item shall be returned at the seller's sole cost and expense.
- To facilitate a successful sale, the seller agrees that TLO may recommend revising or reducing the listing price of the product based on market demand, condition assessment, and comparable resale values.
- If a product fails authentication, is determined to be counterfeit, or cannot be authenticated with reasonable certainty, the seller shall be liable to pay an authentication and handling fee of INR 5,000 per item before the product is returned.
- The seller must settle all applicable fees and arrange collection of the returned product within thirty (30) days from notification by TLO.
- If payment remains outstanding for more than thirty (30) days, TLO reserves the right, to the extent permitted by applicable law, to dispose of, destroy the item without any further liability to the seller.
- Under all circumstances, shipping, insurance, handling, and reshipment charges shall be borne solely by the seller.
- If the seller requests an authenticity certificate, authentication report, or written proof of authentication for an accepted or rejected product, TLO may provide such documentation at an additional charge.
- TLO reserves the absolute right to inspect, authenticate, accept, reject, suspend, remove, or refuse the listing of any product at any stage of the consignment process, including after the execution of any agreement.
- The final listing price of a product shall be determined by TLO in consultation with the seller and in accordance with prevailing market conditions, demand, product condition, and comparable resale values.
- Once a consignment offer is accepted, TLO or the seller will coordinate the collection of the product(s). However, TLO shall not be responsible for delays, disruptions, or losses caused by courier partners, logistics providers, natural calamities, or circumstances beyond its reasonable control.
- Sellers may monitor the status of their products by checking whether the item remains live on The Luxury One website. Sellers are also welcome to contact our team for updates regarding their listed products between Monday to Friday, during the consignment period.
- If the product received by TLO materially differs from the description, photographs, or information originally provided by the seller, TLO reserves the right to issue a revised offer or return the product at the seller's sole expense.
- Products shall be listed on TLO's platform for an initial period of one hundred (100) days. Upon expiry of the initial term, the seller may choose to:
- Extend the listing for an additional thirty (30) days;
- Revise the price; or
- Request the return of the product at the seller's sole expense. The seller needs to communicate with TLO for initiating a return.
- TLO will process the seller's payout within 2 business days after the sale has been successfully concluded and all applicable conditions have been satisfied.
- If the seller withdraws a product before completion of the initial one hundred (100) day consignment period, an early withdrawal fee of INR 2,000 per item, together with all applicable shipping and handling costs, shall be payable by the seller.
- The seller authorises TLO to market and promote the product(s) through any channels deemed appropriate by TLO, including but not limited to: Website listings; Social media promotions; Paid advertisements; Email marketing; Content creation; Collaborations and partnerships; and Any other online or offline promotional activities.
- TLO shall not be responsible for any loss, theft, damage, deterioration, delay, or destruction of products arising from natural calamities, acts of God, government actions, force majeure events, third-party actions, or any circumstances beyond TLO's reasonable control.
- TLO operates on a consignment model. Accordingly, the seller shall become eligible for payment only after the product has been successfully sold and all conditions set forth under these Seller Terms and Conditions have been satisfied.
- If the seller wishes to revise or reduce the selling price of a listed product, they may contact TLO's Customer Relationship Team at team@theluxuryone.com.
- The seller acknowledges that TLO may require approximately eight (8) to ten (10) business days from the completion of all documentation and receipt of the product to inspect, process, photograph, and list the product on its platform.
